TACLOBAN CITY- A commercial fishing vessel using hulbot-hulbot or modified Danish Seine was apprehended along the municipal waters of Brgy. Rizal, Daram, Samar on or around 4:25 a.m. earlier by BFAR 8 Fisheries Protection and Law Enforcement Group (FPLEG) Carigara and Samar stations.

The boat captain and the engineman of the said fishing vessel who are residents of Brgy. Bagacay, Daram, Samar have transgressed the provisions of the Philippine Fisheries Code or RA 8550 as amended by RA 10654, particularly Sections 86 (Unauthorized Fishing), 93 (Use of Fine Mesh Net), 97 (Ban on Muro-ami, Other Methods and Gear Destructive to Coral Reefs and Other Marine Habitat), 113 (Commercial Fishing Vessel Operators Employing Unlicensed Fisherfolk, Fishworker or Crew), 115 (Obstruction to Fishery Law Enforcement Officer), and 121 (Use of Unlicensed Gear).

They have also allegedly defiled FAO 246-1 series of 2018 which amended FAO 246 on the Banning of Operation of Danish Seine and Modified Danish Seine or ‘hulbot-hulbot’ in Philippine waters. Those who will be found guilty of violating this FAO will be facing an administrative fine equivalent to five (5) times the value of fish caught or P2 M. Withal, upon conviction by the court of law, the boat captain fisherfolk and recruiter or organizer of fishworkers will be imprisoned for two (2) to ten years.

The apprehending officers confiscated its fishing gears which are estimated to have a market value of P500,000 to P1M. They have also seized two (2) tubs of fish catch which will be donated to Samar Provincial Hospital for proper disposition.

Further, the boat-captain, the engineman and three of the 12 members of the fishing vessel crew went overboard.

As of the moment, the apprehending team is navigating to FPLEG Samar station for proper documentation.
